    Default poppy pod busts

By ED QUIOCO, Times Staff Writer
    ? St. Petersburg Times
    published June 18, 2002

    --------------------------------------------------------------------------------

OLDSMAR -- Pinellas County sheriff's detectives recently returned to the tan stilt home with large bay windows where in March they arrested a 47-year-old man for receiving opium mailed to him from Iran.

But this time investigators were looking for his wife.

Jill Khanalizadeh, who turns 47 today, was charged with trafficking in opiates, a felony, after investigators say she received two packages containing 213 opium poppies purchased from a Canadian mail-order company. When the U.S. Postal Service delivered the packages May 31, undercover detectives were monitoring the delivery.

Once she accepted the packages, she was placed under arrest, said sheriff's Sgt. Greg Tita.

"She claimed that she had bought it for floral arrangements for an Iranian wedding that she was involved in," Tita said. "That seemed highly unusual, considering her husband was arrested two months earlier."

She also was charged with misdemeanor possession of marijuana and felony possession of cocaine.

Her husband, Davoud Khanalizadeh, was arrested in a similar operation this spring.

He was charged with trafficking in opium after he received a large package containing 2.2 pounds of opium on March 21. The package was mailed from Tehran and caught the attention of U.S. Customs agents after it arrived in the mail at John F. Kennedy Airport in New York.

Reached Monday at the couple's home on 360 Wellington Ave. in Oldsmar, Davoud Khanalizadeh, who also goes by David, said the couple was "just totally devastated" by the charges but declined to give further details.

"They are not true," he said. "But what can we do? We are going through due process."

The couple is free on bail.

In a sworn statement included in the search warrant, sheriff's Det. Eugene R. Lebrecht said opium poppies can be ground in a coffee grinder and boiled in water to make poppy tea. When the tea is consumed, users can get an opiate high that can last several hours. The tea also can leave a residue that can be eaten or smoked.

A postal inspector flagged the packages when they were delivered to the Oldsmar Post Office at Bayview Boulevard on its way to the couple's home. After reading the mailing label and viewing the company's Web page, the inspector got a federal search warrant to search the packages.

"They did a more thorough examination of it and brought it to our attention," Tita said. "We, too, examined it further; and we decided we would go ahead and make a case of it."

Lab tests determined that the poppies contained morphine and codeine, which are found in opium, according to court records.

Investigators set up an undercover operation for mail carriers to deliver the packages with the Sheriff's Office watching, Tita said.

An arrest report showed that Davoud Khanalizadeh is a U.S. citizen who was born in Iran and has lived in Oldsmar since January. He was a naval aviator in Iran in the late 1970s.

"This is really going to destroy our lives," he said.

That isn't good. They are supposed to be legal for floral arrangements...

Airlines veterans face felony charges over poppy seedpods
'It's the same as possessing cocaine or heroin,' says Summit County prosecutor

PARK CITY - They're pretty to look at. You can buy them over the Internet. And a Summit County prosecutor concedes they're practically everywhere.

Nonetheless, an airline pilot and his flight attendant fiancée are facing a felony charge for possession of opium poppies - or more specifically, the dried seedpods from opium poppies.

Park City residents Bruce Sanchez and Cynthia Owens were bound over for trial last week by 3rd District Judge Bruce Lubeck for possession of opium poppies, a third-degree felony, punishable by up to five years in prison and a fine of up to $5,000.

They also face misdemeanor charges for possession of marijuana and drug paraphernalia.

The pair pleaded not guilty. A trial has yet to be scheduled.

Sanchez and Owens say they lost their jobs at Delta Air Lines as an outcome of the criminal investigation. Each had worked for the airline for more than 20 years.

The details of their departure are sketchy. The veteran pilot said he was suspended without pay and chose to retire and claim pension benefits. Owens said she was fired.

A Delta spokeswoman said the airline would not comment.

An attorney for Sanchez, Richard Mauro, maintained the couple had purchased dried ornamental poppy seedpods over the Internet for decorative purposes. Further, he questioned whether the seedpods seized during a Sept. 20 narcotics strike-force raid were that of the opium poppy species, Papaver somniferum.

But in a preliminary hearing, botanist and Brigham Young University Professor Emeritus Stanley Welsh testified with "absolute certainty" that the seedpods were from the opium poppy.

Summit County Prosecutor Paul Christensen noted that the 40 seedpods and a small amount of marijuana seized from the couple's bedroom indicated they were not involved in drug trafficking.

But he added that the case would go forward because possessing any part of the opium poppy - except the seeds - is illegal, whether or not they were dried.

"It's the same as possessing cocaine or heroin," Christensen said, "because the Utah Legislature says so."

Park City police Capt. Rick Ryan said that because the criminal case has yet to be adjudicated, he could not comment on what led police to the Ontario Avenue residence.

why the hell would they flag a package out of the blue?
i call bullshit, they knew that the husband was trafficking in drugs and inspected his/her incoming mail...they dont magically just see someones package and decide to do internet research on it,find that its a pod vendor and get a search warrant to open the package

Not good news. Hopefully these kind of incidents will remain isolated in nature. I would just hate to see a big uproar about all this, shining too much light on the already grey legality of pods.

It seems like they are just putting pressure on people in pain from every direction ,

like people who smoke they are always fucking with us, one thing after another .

Well ya know what happens when too much pressure is put on people. They explode.

They better watch their asses. Some day it might just explode on them.

hey clinton, just curious, where you gettin all this info, youve posted a few. this is the only one that worries me, i guess it would be worth it to check state laws about pods. like RB said tho, here in CA it dont matter, we votoed med MJ in an it passed but feds fuck these growers and clinics over all the time. wether you have yer med card or not, if you get pulled over here yer fucked. without thos pods alotta of us here would be fucked, and thats putting it mildly i imagine.

I wouldnt worry. This is no isolated pod bust. This is a drug dealer, and they know it, so they found a loophole to get a warrant with the pod delivery. This wasnt about pods, this was about pot plants, and coke I'd bet.

They were probably dealers. The cops knew it. And they found an easy way to get the warrant from the pod delivery, and bust them with pot, coke, and hell a bonus with the pods.

I would NOT order them to your address anymore, love. The whole dude in a Taurus & him coming back sets off my paranoia alarms.
And what DUDE does flower arrangements??? (yea, I know...). Do you have an Aunt Mabel who does 'em & you bought 'em as a birfday present since she's on a fixed income & all?
I would not worry too much about this time but I wouldn't do it again.
If they're onto poppy pods in Utah, where people REALLY DO use 'em for floral arrangements, then they prolly know about them all over the US.

What the hell do they want from us?? I mean... are we seriously bothering anyone? Always wanting to control every little fucking thing... next thing ya know, we'll have to file for authorization to take a shit.

Thanks for diggin' this stuff up, Clinton! Glad to know someone's keeping their finger on the pod-pulse... I've been slacking off, myself, lately. Appreciate it bro.

I would not freak out about it. The USPS uses private contractors all the time in some areas. Some dipshit in a Taurus sounds about right. He probably did just forget to scan the package or something.

Was it opened or anything before you got it?

Plus, you did not get arrested after signing for it. I would highly doubt that the L/E are doing any kind of sting on you.

I can understand why it made you nervous though.

In rural areas, lots of post office work is subcontracted. (Do you ever see the ads in your local paper for post office jobs? They run them all the time here.)

Did the package have all the normal overnight stickers, paperwork, etc.? If so, it's probably on the up and up. Did it come from a vendor you (and/or others) have used before?

I wouldn't worry about it. I've had packages delivered with seeds dripping out the sides and no questions asked. The only issue I've ever had is one time the postman rang the doorbell because he was concerned about my package. He was convinced something was broken inside and he wanted me to try to get a new "whatever you ordered" from the vendor! LOL! I told him it was gardening supplies and seeds and he relaxed. (Scared me to death, though, when I opened the door and saw him standing there with my box.)

I'm not thinking too clearly right now, but I think the article said it was shipped from Iran so it might have been looked at closely because of that. Shipping pods through customs seems risky in the first place, especially from a middle eastern country.

jim hogshire got busted with pods, but he wrote a book about opiate and pods a few years before that.

his publisher asked him if he could be a journalist up for a few days, cause the guy was in Jim's area.

the journalist felt that Jim was a bit unbalanced, and after being shown various illegal products, decided for some reason to report the guy. the journalist was a loompanics associate, which is a publishing company that sells all sorts of drug and crime related books/magazines. if you are crazy, and want to write a book about how to use methamphetamine and then how to blow something up, all while you create a new identity for yourself, then loompanics is the place to look.
I just find it strange that a guy associated with that company decided to do Jim in.

best thing to do if you get busted for pods is tell the truth. tell them you used to be a hardcore heroin bangin, speedball buster, junky, that that through the power of herbs, and god, you have found a sanctuary, a refuge in shivas garden, through the use of poppy pods and other flowering plants.

yes, it seems that almost if not all pod busts were either a predicament of some cops just stumbling over the pods during some bust for other reasons, or, in the case of one of the storys at the start of this thread, some idiot pulling attention to themselves by ordering bricks of opium straight out of Iran.
I hate to say it, but in this rascist, overreactive country, getting packages from Iran is not a great thing, unless you are in the Military, and are a higher up.
one problem cops would have, is getting a search warrent for a product that most likely will be gone when the doors are kicked down.

I personally think the DEA is letting this pod industry continue for the most part. food brokers still can order poppy pods in by the ton, but most likely you better be connected to a flower store or something. still, I know a company was brokering pods into the USA via shipping containers for years now.

one time I saw a front window display of a large arrangement of flowers, there were some HUGE fresh green GIANT poppy pods in the display, and I noticed, drooling, that at least a half gram of opium was collectively seeping out of these huge pods....
also, in seattle, coming from the market area downtown, a few people had bunched of pods in arm heading on their way home, some flower shop was selling them by the 35 count bushel.

I think pods are pretty much going to be like weed, they are too easy to grow, for people to not sell/produce, and they are ignored in to many countrys to the north and south of the USA, those countrys are a good place to order pods, even going through us customs.
just use usps though, unless you are using other couriers overnight or express shipping.

larry you're gonna be fine. you are fine.

by the way, I don't live in a rural area; it's not a large town but it's a town.

when i get an overnight usps delivery of anything, the person who brings it comes in a private vehicle or little truck. it's a way for them to get all the "by noon" express mail out without making the carriers wait for it to come from the downtown (bigger) hub post office. it really doesn't mean anything.

one time (it is usually the same older guy and he does work at the post office since I've seen him there) asked me what was in the package because it was rattling. He was making conversation; I told him I was into beadwork and it was a shipment of some special small Indian beads. he wanted to talk some more but i really needed to open the package and get down to work since my bead project was waiting. I could have been paranoid but it was nothing.....

Sue and by the way, I don't use FedEx or UPS (esp FedEx) since I do not like their business practices in terms of cooperating with the authorities on what should be our private business.

I can definitely understand why you were nervous, and I always got nervous the night before and the day of receiving an order, but chances are nothing will happen. Plus, just so you know, the USPS uses a separate facility most times for Express (overnight) items. Sometimes they'll come from the post office your regular mail comes from (i.e., your regular mail person will bring them with your regular mail), but most of the time they have separate drivers who only do express deliveries, and they don't always drive USPS trucks. I've had them delivered by USPS people who drive regular cars before too. It's not a big deal, but I can understand your paranoia if you didn't know that.

The only time you'd have to sign is if it's Express / Overnight AND you didn't sign a release waver to just let them leave them there. If you don't sign a waver, they have to have you sign for them. Unless, the sender waives the signature box, but in order for them to do that, they have to sign for them, and what vendor is going to sign your package so you don't have to.
