You stole something that was worth less than $500, and had pot and paraphernalia and are facing 5 years max? Good god. Unless you have 5 priors I doubt you'll get more than probation.

I hate seeing people getting shafted by some of these public defenders (pretenders) who won't fight for you. I assume you are pleading guilty. No drug court?
Did you steal from somone who would testify against you? **But don't incriminate yourself**
You have to make your lawyer work. Call him all the time. Take notes. Be proactive and maybe if your laywer really doesn't do shit you can appeal. Ask him why there is no victim's age filled in and ask him what the probable cause was. Don't just listen to him/her. Even a defender that's appointed works for YOU.
As long as you can write you can fill out appeals. But if you plead guilty you can't appeal unless you show that your plea was based on your bad lawyer. So just make sure you deserve to go to jail b/f you decide to plea. If you're passed the plea stage of this, sorry I couldn't tell you this stuff earler.

i got caught with heroin residue, a needle, 2 half full scramble caps, and a spoon...
theft under 500:: 18 months max
cds poss:: 4 years max
paraph charge:: $500 fine x 3 for me.
-- i just got null proccessed on shit in baltimore, i had 4 cds charges for heroin cuz i had caps on me, fucking knockers. that was a 16 yr max, but i got lucky i guess.

4 charges? huh? The dope was cut with 4 different controlled substances?
It's not about whetehr you are guilty. It's about the sentencing and the whole negotiation leading up to the plea. The whole process is tainted...not just in your case...
Good laywers get guilty people out of trouble all the time. I mean..I think stealing is wrong and all but for purely drug crimes, I'd always fight.

the cops kind of charge you how they want... and leave the courts and your lawyer to deal with it,
they could of just gave me 1 charge but i had this asshole cop who was a fucking dooosh

I'd say you're lucky that they even have a 'theft under $500 category'
here the lowest misdemeanor theft offense is <= $2500, so even if you steal say $150 worth from a store, you get the same offense as if you stole 2 grand worth... stupid stupid stupid... granted the lower dollar amount may do something in court or in the DA's mind, but probably not.

Nothing of real consequence to add, but wear a shirt and tie or something respectable; you want the judge to know you're taking it seriously and with respect.
And while its important to follow proper decorum, stick the fuck up for yourself, especially in consultations with your lawyer. Let your public defender know you intend to appeal on the basis of inadequate counsel if you think she's not rigorously defending you.

What you need to do is draft a letter with the dates of each time you tried to contact the lawyer. You need to keep track of every attempt and you should even have written your lawyer a letter asking WTF? That's good proof if you send it return receipt requested. If you can prove that your lawyer wasn't returning your phone calls you should at least try to appeal.
But you probably won't win unless you can show that had your lawyer acted properly, you would not have been convicted. It's pretty hard to prove that. But if you plead guilty it might be easier if you argue that you were calling your lawyer because you were uncomfortable pleading guilty to something you are not sure that you are guilty of. In the case of plea bargains, one of the ways to get a plea agreement retracted is to succeed in proving ineffective assistance of counsel.
That latin prase looks like it means that the prosecution fucked up.

Look, man, I'm admitted to the MD Bar and while I haven't practiced law and likely never will, I can tell you you're getting the shaft by this PD. You're basically leaving the outcome up to the whim of the judge tomorrow. If he/she is in a shitty mood and feels like making an example of you, you're fucked. Don't put your future in someone else's control. Call a lawyer right now! There's still time for someone to help you. They can ask for a continuance for you to get the time needed to sort shit out. DO IT! It will be the best money ever spent.
In my humble opinion, every person on this forum who dabbles in the illegal should absosmurfly have a lawyer in their back pocket. Cops will throw every charge they can at you in hopes that at least some will stick. An attorney will fight that battle for you. A public defender doesn't necessarily have your best interest at heart. If they were so kickass in the courtroom, they'd have a private practice or be in a much more lucrative position elsewhere. Seriously.
If I didn't have kids to tend to, I'd help you out myself. :)
p.s. It is nolle prosequi and it roughly means "unwilling to pursue". For whatever the reason, it has been dropped.
p.p.s I also don't mean to offend. There are certainly some public defenders who do what they do and do it damn well because they truly want to help the less fortunate. However, those are becoming fewer and farther in between because at the end of the day, money talks. A PD also doesn't necessarily specialize in one area of law - they defend everything from drug possession to child abuse. It is hard to be a master of your craft when you have 100 crafts to master, know what I mean?

I'd listen to Flowergirl. My attorney got me a deal 10 years ago where I was allowed to plead guilty to one 2cd degree felony, rather than all 7 I was charged with.
Got 3 years probation, served 18 months. Best 4G I ever spent....
Got it all expunged earlier this year.

i was locked up for like 3 days, then i finally got someone to post bail for me.
best of luck my friend....i will NEVER forget standing in front of the judge waiting on him to sentence me. its the absolute WORST feeling in the world (aside from getting a call that someone close to you is hurt/passed).
what the judge did to me was sentence me to a VERY long time for my charges (i thought and my pay lawyer thought also) then said the magic words "suspended too" and i wound up with probation. keep that in mind...not sure if its standard practice or not...but if he heaps alot of time on you and pauses...giving you the evil eye theres a good chance the word "suspended" is coming.

They usually watch your dick on probation. I.e. "Face me, I'm looking through a peephole in the door, at your dick, with the piss coming out of it" kind of watching. At least they do here,on county probation. State was a different matter, but I was a juvenile then-dunno how it's different as an adult, and in his particular state, to boot.
I wouldn't risk the felony of tampering with a state drug test. Met two guys in jail for that exact thing.
Better idea to time your use to the time exactly after and stopping two weeks before your probation visits. Much safer.
Hell, just go a few times before coming in dirty so you get an idea of the routine.

I myself just missed a court date & probally have a warrant out & it's all from a cival suit for braking a lease back in 2002, in wich my ex is also onlease but they go after who ever they can find.
I missed a bunch of dates so this last one was for contempt, I never thought cival case's wentthat route.
Thought i'd get a lean against me an it would be over (my credit is fuct anyway) But back to you, hope everything goes o.k. & ya do'nt get any time!!
