well, i've been reading on poppies.org long before i even posted here but i just didnt know what SWIM was. I thought SWIM was the name of some guy everyone liked to use to forgo responsibility but it implied your own self in the opiod community hehe

I still don't get the swim thing. Is it for plausable denial in case of a search order? Is it to throw off suspician from the police? Is it simple denial? Most of us who are still using can't stand close scrutiny if investigated. Simply saying "swim" will only throw off a mind-numbingly stupid investagator. Cops are not the brightest guys in the world but few are foolish enough to believe that 'swim" is actually another person and not the writer of the tale.

Read over some of the way people use swim. To me, its so obvious to me that they are talking about themselves that i can't imagine a judge saying to a cop or prosecuter " It can't be that personl, he said it was someone who isn't me. Search order denied" . Does anyone actually believe swim offers any real proctection?

I myself remember readimg about SWIM getting her ass grabbed everytime she tried to score heroin and I felt so bad for her.I also kept wondering to myself who this SWIM person was for everyone to know him/her so well and care about this person so much.I'm so glad that when I was a N00bie I read the forum rules or furum format and found out before I asked the question cuz I just woulda felt so embarrassed.Its not that big of a deal though I mean but if you read the rules b-4 you post you maybe wouldn't embarass yourself like you did and I almost did!

Something to do with it all being heresay (like, you were just bragging to show off), and thusly inadmissable.

Now if you were talking about a murder or trafficking kilos of dope or something, it might (probably would) make any trolling LE stand up and take notice and search for more info about you at the very least.

Anyone here have the actual legal knowledge in regards to this? 'Cause I'm real interested in knowing just exactly what the law is on this kind of thing. I think the whole SWIM analogy is kinda dumb and I hate using it.

ZK this is certainly not true... there are a lot of urban legend-type legal stories and info all over the place these days, thanks mostly TO the internet. I'm not a lawyer, but gov/law/politics is my industry and I've had a lot of legal training. I'll get you solid proof this isn't true if you want, but if you don't care about the details just know its not and go from there.

Its hard to say with SWIM. I don't think that its really so sneaky and smart that it would fool many people for very long. As for culpability, usually you have to be committing an act of crime or negligence, and technically its not illegal to DO drugs or to BE a drug addict in the US. Its illegal to buy and sell, because of the fact that congress used the 'interstate commerce' clause to regulate drugs.... and by extension (and case law, etc) its illegal to possess because one would assume you had to buy or sell it. And don't try the 'it was given to me free' or 'I grew it myself' (especially the second, for fuck's sake, unless you want your house taken)... the courts have also extended the power of interstate commerce to both (god please don't ask me to get into all this unless you REALLY care).

I could go on with the SWIM thing but I haven't really made my mind up, and as far as I know the courts haven't visited this thing yet, so for now things are ok.

Your absolutely right, it is technically not illegal to have drugs, or drug metabolites, in your body (unless they pop you for "public intoxication" or DUI or you are on probation with stipulations including U.A.s) it is the possession and sales that determine legal reprimands. Although I still do not put much stock into this whole "SWIM" thing as a means of detering accountability... it is probably a good idea to not post anything under any psuedonym that implies illegal activity. I mean, if you have a question just ask it without a protagonist as a general inquiry. I sincerly doubt that the posting of such information soley (as long as you are not talking about trafficing/dealing or bragging about felonious quantities of illegal substances) will draw the vultures to you... although, if you ever got into drug related trouble in the future I suppose that they could use your incriminating post/threads as evidence to defame you in court.

I do think you are correct, buying, selling, and driving around town with 4 kilos, etc. are probably not good. Also a large amount combined with firearms is really not good to talk about. Most of this site seems to be centered around experience, prices, dos and don'ts, etc. so none of that really qualifies.

As for using posts in court, if its some small misdemeanor or even a minor felony I wouldn't think anyone was going out of their way to find this site. The only time is maybe if someone files a civil suit and there's a high powered high payed overeager lawyer digging all the shit he can. Or maybe if its a capital case or a federal case etc.

My main curiosity comes from whether this would ever appear in a background check for a federal gov job... they are pretty fucking thorough. Especially some type of clearance.

If one were applying for a top secert clerance in the military they would start with your med records among other things. If you get untold amounts of opiods then you would probably be turned down. Anyone here ever been pinged by L3COM? Most of my family carries the TSSC and you would be surprised how little it takes for them to yank that away. But again unless you are talking about getting 4 kilos or your really efficient Meth Lab. The fact is they really aren't that interested in us.

All of my post was a joke (it just wasn't terribly funny), including the hippie parents. My mother was a psychology student in college, and my father was (and for all I know still is) an attorney. They're about as un-hippie as you can get. And sorry, I don't know your schoolmates, I don't think I'd forget names like that.
