I read this story on another site I go to some times and though I would share it with you all, so this is where the war on drugs have got us?


Marijuana: "Substantial" Settlement in Lawsuit in Case of DC Quadriplegic Who Died in Jail While Serving 10-Day Sentence for a Joint

The mother of a quadriplegic inmate who died after suffering breathing problems in the District of Columbia Jail has reached a settlement with the DC government and care providers. While Jonathan Magbie's mother declined to reveal a dollar figure, the ACLU National Prison Project, which helped litigate the case, called the sum "substantial."

Magbie, 27, a resident of nearby Maryland, was paralyzed from the neck down and used a mouth-operated wheelchair to get around. He was arrested in April 2003 when DC police found a gun and a small amount of marijuana in his pocket after they pulled over a vehicle driven by his cousin. In September 2004, DC Superior Court Judge Judith Retchin sentenced him to 10 days in jail after he pleaded guilty to marijuana possession. Although it was Magbie's first offense, Retchin later told a judicial review committee she sentenced him to jail because he said he would continue to smoke marijuana to relieve his pain. Magbie died before making it halfway through his sentence. He needed a ventilator to breathe at night, but the DC jail infirmary didn't have one. Investigations after his death determined that he was taken to a hospital for "respiratory distress," but later returned to the infirmary. Jail doctors did not perform a follow-up exam, nor did they regularly conduct rounds to check on patients, including Magbie.
"DC's jail system had a duty to care for Jonathan Magbie's serious medical needs," said Elizabeth Alexander, director of the ACLU National Prison Project. "The jail and the Greater Southeast Community Hospital failed to live up to that obligation and it resulted in an agonizing and unnecessary death."
As part of the settlement, correctional officials have agreed to modify a number of policies in order to protect prisoners with severe medical problems and physical disabilities, including modifying the medical screening forms for incoming prisoners and spelling out medical conditions too severe to be treated at the jail's infirmary. Also, prisoners with medical needs that can't be met by correctional staff must be transferred to a facility that can provide an appropriate level of medical care.
"The family's concern was to make certain that, to the extent anyone can prevent it, that this terrible type of event never happens again," said Alexander. "A series of people dealt with this young man, and every single place where something could go wrong, it did go wrong."

This makes me FUCKING SICK! Like this guy hadn't been punished enough by being a quadriplegic, but then gets jail time for a 1st TIME weed possession. That's ridiculous. It's even more sickening that they let him die in jail. Just WOW!!

he would've got a fine or some probation, if the judge is white that is but what if he was white and the judge was black. It works both ways. Trust me, i've been to court plenty of times and been in front of black and white judges

I agree kinda, except I find that most of the time I get discriminated against by white police officers for being the only white person who has an apartment on the block etc.

I have to respectfully disagree on the black judge thing. Yea, I don't have a criminal record conviction wise, but I am familiar with the legal system...prob all too familiar if u ask me. (My ex was a dope seller.)

Until our bodies are our own again we will not be free: the criminalization of drug use, has been an abject failure, and as they slowly replace criminalization with medicalization, we are finding out that it can be even worse: probation is just the beginning of imprisonment tomorrow, which we trade in for the perceived freedom today...every junky usually starts their incarceration with probation...then hits the harder road when we refuse to knuckle under...but when u sign those "probation" papers...u might want to read the fine print...

This guy is just getting fucked from the get-go, rather than w/the usual foreplay...me too: I went straight to prison, 1st offense no probation--5 to life--years later I was given probation, and my girl too...I've visited her in prison many times since that little "break..."

Its fucked...and until enough of us realize the total unconstitutionality of this crap, we are doomed....

I think so too, but we gotta keep hope alive: I've been wrong about so many things...and we must put a brave face on every sad new situation...

And we have fun at times, and find love and friendship, and our troubles can seem small, then...and other times it really does suck, but knowing you aren't alone sometimes gives comfort...

I think we already are. (doomed)

The human population will probably eliminate itself before we see real changes to stop this bullshit from happening. I hope that things will be different years from now but I'm really not counting on it

I wondered that too, Tuesday. I've heard that DC is sort of racially divided. Not sure if that's true or not, but that's what I heard. I don't think it's bad to think of that though. I don't think it's fair at all, but it's a fact and you have to ask that question. Because, if you don't ask it, then people get away with it.

I hope the judge is really proud of herself....Sending a fuckin quadraplegic to jail for a joint....Obviously she was sending a message....The fuckin wrong one.....I hope they paid major bucks, and if the guy was my bro, i know where i would be spending some of dat wonga.....

I wont say it exactly on the board, but just know it would be spent on finding out an address...Coz it looks like the guy had an agonising death.And i believe very strongly in payback.....

Ya know what, a trial judge a mine at the old Bailey said to the jury, "I been sittin here for 25yrs and have formed my own opinions about this case, But you must disregard any opinion that i have come to and have no sympathy for the defendant.He will be dealt with adequately by the athorities".....

Fucker told him to find me guilty, thats basically what he did.And coz a dat i won my appeal.And this is for something i woulda spent probably 20yrs in jail and been on parole for the rest of my life.When i eventually got out, if ever......Judges are private educated cunts, mostly fuckin paedo;s an fuckin weirdo's.Who were probably buggered the fuck outta...

i dont see no hope in this subject.... short of assassinating the drug czar. the war on drugs finances too many people. i dont really think, and just my opinion, that the non-decriminalization
of drugs is as much an issue of "our bodies being our own", rather a business. the war on drugs is a fucking cartel, consisting of politicians profiting somehow or another. too many people will loose too much money the day the war on drugs is over. a fuckin racket. it surely cant be a matter of them thinkin they have our best intrest in mind, cuz even a fuckin chimpanzee can see the positive outcome of decriminalizing drugs. prop 215 proved that it dont matter how many of us WAKE UP
we passed the prop here and they took it away. anyway just an opinion

I also think this situation is terrible, but I think there is one question left to be asked. We have a guy here who need a breathing machine to get though the night, and presumably through the day. Should this person really be smoking unfiltered marijuana, let alone a filtered product like a cigarette?
(not sure if they mention cigs, but only assuming) I personally approve of people smoking anything they want to, especially if it came out of gods green earth, but I am just pointing out the things I see in the story.

Just an opinion.
