Kinda nutty, however ponder this: With the passage of the Comprehensive Drug Abuse and Control Act (The "CSA" with the schedules) the Harrison act and preceding laws were repealed. These "laws" derived their force through the 16th Amendment, the taxation one. Where does the fed derive their power to control plants and chemistry, and most core to the issue, to control what free citizens ingest and even more so, where do they derive their self proclaimed authority to dictate to our most sacred individual beingness, our inner consciousness and state of mind, which we alter and manage (though not truly control) via sleep, love, sociability, meditation, spirituality and psychoactive substances? More than speech, press, abortion, marriage, etc, their is nothing more "individual" and sacred than our own minds! If I'm ever arrested under any false pretenses or even for possession or whatever, this shall be my defense, and I'll take it to the Supreme Court. I just dare them to take me on on this one...
If the SC can find a Constitutional right to terminate pregancy (I agree that it is a woman's choice, though I believe the father should have input, and only until the baby can survive indepently), they damn well can find in the Constitution the right to manage our own minds and emotions and spirituality. Anything else is no less that attempted THOUGHT CONTROL!!!

I know there is desperation--and intelligence--behind those kind of defenses, and a strange and honest political philosophy, often in the hands of white supremacists, non-taxpayers, and ...dare I say it...libertarians like me, who realize the gov't in this country was *designed* to be the minimum amount of gov't possible, and the people were *purposefully* given guns to see it stayed that way....but we ain't that way no more...

I finished it: really good article, and glad you posted it...I tend to trust what you say is good, Nick, and this was worth the read...I've been around a long time, and in my biker days, I remember often bike gangs and such were also often attracted to the whole Posse Comitatus (sp?) idea, and also of course to racist ideologies and such...
I dislike all of it, and these guys were cold murdering thugs, and I don't waste any pity on them...but I do agree that somehow what this gov't was designed to be, has morphed into something that is ridiculous and cruel...it gets more and more repressive, and people always tolerate it, as long as its not *them* being repressed...but as I've said before, 100 years ago, people could put what they wanted in their bodies: it just wasn't the gov't business...but in sneaky ways, they just keep getting more and more power...ah, I'm off to bed....

im using the thought control defense for sure.
the govt doesnt realize that all the people who kill each other over drug money, drugs, drug territory, etc....if they werent trying to control this, but actually embrace it, and tax it like everything else, there wouldnt even be cases like this. it really is rediculous that they think they can control what we put into our brains, and like robo puts it, control our mental states. people are gonna do it anyway, why waste taxpayers money puting them in jail for it.
but yea, the way things are now, and the fact that these guys put bullets in these peoples heads sometimes for no reason, they should rot. but in a way that I dont pay for, like hanging right after the trial or something.

...and the really fucked up thing about this whole story, and the underlying theme, is that if you are seriously ready to clog up the legal system with these insane defenses--and on a murder beef, why not?...yer not going anywhere....*then* the prosecuters will finally just get worn out, and offer you a plea bargain...so this defense obviously was a good ploy on the part of these fuckers: that's the moral of this whole story...yeah, it's interesting, too, that a theory espoused mostly by white supremacists, and "the jews are the source of all evil" idiots, is now used by local black street thugs who previously thought the Constitution was just a street to sell dope on...
Real problem is our courts are so crowded with all the crimes that the gov't has no business prosecuting, so they don't have the time or money to go after the real monsters like these bastards....the real story is that one....

the whole story reminds me of a law and order episode where these black kids were putting out a record, and had funded it through selling drugs and the prosecution used some of their lyrics to try to convict them of some murders. the kids really did have this ingenious way of getting out of the charges, one of them had killed a record producer who was a rapper in the 80s and the kid who was charged got out of it by having his friend, the one who really did kill the guy confess, but not before getting 500,000 from the first kid. so then when it would have come to the other trial of the other guy, he would have just said that the guy paid him 500,000 to SAY that he killed him, neither could be tried again due to double jeopardy, and they both would have just caught some perjury charges.
but i still remember those lyrics "yo i sprayed him with orange delecta." they had used 2 litre orange soda bottles as a ghetto silencer in all the murders.
