Possession of a Needle/Syringe (2 part question)

Hey yall,
I have a 2 part question for ya here.

First off,
My girlfriend and I travel around working at the large music shows (where drugs are rampant) Shows like bonnaroo, Langerado, gathering of the Vibes etc....

So we are starting a mobile "needle exchange" (we are going to be charging money for clean kits, but its going to be a reasonable amount, to cover fuel expenses and inventory costs). this idea came to us after we watchec people buying and selling dirty rigs for like $5 ea. I still can't believe that a person would knowingly buy a dirty needle from a total stranger.
That totally throws me off.

We are going to sell a "clean kit" that would contain 1 clean individually sterile packed needle/syringe, 1 of those little blue tubes of sterile water, some dental cottons, (i would like to find those little metal cookers en masse but don't know where to find them), and we are also including a sheet of paper listing ways to tell heroin apart from fentanyl, drugs that don't mix well, and what to do if you suspect your friend is Overdosing, and also how most people contract Hiv/Aids and Hepatitis. (Unfortunatley most people only think that you can contract a disease from a dirty rig, when it can actually be spread from a used cooker, cotton, needle, water, etc....)


So on to the actual question.
Doeds anyone know where to get items like those individually packaged sterile water tubes, those little metal cookers, or dental cottons? I can get 100 piece 30ga insulin syringes in Maine for $12.99 (totally legally w/o a prescription).
And does anyone know the legal status of posessing a clean needle in the state of Tenasee?


And the second question (on a different topic)

My girlfriend got popped for posession of a dirty needle (just one,and it had suboxone in it) I have been looking around in the state law books but can't find anything conclusive.
This is in the State of Maine.
can the police charge her with possession of a controlled substance for just the trace amounts of a drug in a needle? (the needle itself is legal to posess (clean) but dirty does it become a seperate charge? And would posession of One dirty Rig with Trace amounts of suboxone be a misdemenor or a felony (She has 1 prior Disorderly conduct, and 1 prior Shoplifting charge but no prior drug offences)

I'm not really sure either man. I know that if your g\f gets "help"\goes into a rehab before her court date she will have a lot more luck with the legal system..

As for selling the rigs and everything I have no idea what the laws are for that, but I believe it varies state to state...Even if what your doing is legal, I would not be surprised if cops fucked with you. Passing out fliers promoting drug use (in their eyes its promoting it) could probably turn into some bullshit charge like public endangerment or who knows what..

Just my two cents man..

Hey thanks for the replies.
As to being fucked with, if you've been to one of these mega shows (or even one of the smaller ones) there are "shakedown streets" where you can go and people walk around saying "I've got doses", "I've got pharmies", "ive got extacy" etc..... the cops already have plenty of people selling drugs to fuck with.
I am hoping that the cops will see the fact that we are engaging in some form of harm reduction rather than straight up drug sales and over look us (that is of course assuming that police act rationally.

Either way that is a risk that we have discussed and judging from the sevarity of mis-information and extremely risky behavior that is going on at these shows (by kids as young as 16 and 17 and adults in their 40's+ who should know better) that it is worth the risk to help stop the spread of disease, help to spread *some* awareness and honestly make some money in the process so we can get our fix :)


Unfortunaley we will not be at rothbury. The promoters want WAAAY too much money to be there (especially for a first year show) and they can't gaurentee a turn out ala "Echo Project" (just south of Atlanta last fall) They were expecting a turnout of a minimum of 20,000 up to 40,000+ and got 8-10,000. They lost so much money that the promoters cancelled a 10 year contract for the show. Bands started bailing left and right, and even the bands that showed up played shitty shows because no one was there. I've seen Les Claypool in all of his incarnations over 20 times ion total and that was the worst show I have ever seen him at.


Again thanks for the replies and if anyone has any ideas on how to source out these things it would be much appreciated (Or if anyone has any good statistical information to put on the paper, and good drug interaction information and OD rescue info)

If we really cant find anything, We will just sell a pack with Alchol wipes, Q-Tips, A Clean rig, and an Informative paper for $5.

Also if anyone has a good website to direct people to on the paper that would help.
I didn't really want to direct hundreds or potential super morons to opiophile so unless I get a positive word on that I won't do it.

@op, can u just give me an idea what & how many would come in ur kit?
B/c in chi & probally many other towns where they have them needle exchange mobile's that drive around. We get for every needle we turn in 2 for 1, then as many tins as we need, same as water bleach cottins & a few narcan's. They are all on safty. If I am lazy & just wanna go down the street to the local walfreens then it cost me 2.55 for a 10pack of darts.

IMO, I would approch ur local hospital & say ur gonna start a needle exchange & a prevention Re: o'd's or Hiv ect, but do not tell them u are gonna charge. Just exactly what u told us here & what u seen in the past & how u wanna stop the use of dirty works being past around. They will ove it, & give u all the shit u need for free. Then if u make alot of show's u make a card up, so if u have followers that go to all these shows if thats what u talking about ect ect.

Every thing else can be a tax right off.

In the state I reside in needle exchange's

are not legal

The only thing that they could legally do was sterile water,bleach and filter's

Not to mention the for profit angle would more than likely end up w/legal fee's

However Donation's are legal so you may be able to get away with that.....maybe

First off, I want to let you know that I think what your proposing to do is no less than heroic...that being, you are putting your personal well being aside (to an extent) in order to provide a safety/information service can could potentially save a LOT of lives.

Second, the State of Maine has a very gray area on the books as to possession of a dirty needle, however, it is very clear that
"Law explicitly or by judicial interpretation criminalizes possession of trace amount"

unfortunately Maine is one of those places where residue on a bag, a little scraping off a pipe, or in this case, trace amount in a rig is criminal.

But I do agree that if your g/f seeks help before the court date, it could greatly increase your/her chances of getting off with minimal consequences.

EDIT: Somanax is right in that, cops are thoroughly brainwashed before they are put on the street and are stripped of their human ability to make judgment calls. If a law is being broke in any way at all according to "the book" then they will arrest/fine/etc. They can not look at things as "harm reduction" if it can in any way be interpreted as "unlawful"

This website should have alot of stuff you can use, like alcohol swabs and cotton. As far as the cookers go, I wouldn't have the slightest idea. Maybe someone else could help with that.
