11550 Charge agianst me, what to expect?

Hey guys, ive been lurking these wonderful forums for a long time but havent posted too much. Well, I was charged with an 11550 (Being under the influence of a controlled subtance) in april of 2007 and i went to several court dates, but every time they told me the distrct attorney or whoever looks over cases hasnt reviewed my case yet, so i thought mabye they were eventually just going to drop it but i was wrong. I recieved a letter in the mail a couple weeks ago saying i must appear in court on feb 26th for my 11550 charge. I really have no idea how the court system works, ive been researching it, but havent gotten too far, anyway, im wondering if any of you can tell me what type of charges im going to recieve like jail time or prohibation/fines. By the way i live in california. Also if any of you can tell me what is going to go on in the court room, will i have to talk to the judge and explain myself. I have a public defender too. Im worried because i have a H habit and i dont want to end up going to jail and having to kick the h in jail, that would be a terrifying experience. Anyway enough of my rambling, if anyone could please give me some information on whats going to happen to me i would greatly apprecfiate it.

i live in canada and things are different here so i can't really help you with the court stuff but as of the h problem you should try to get on some methadone cause if you have to go to jail as long as your on it they should give it to you in there . i know that they do it here .at least it will keep you well wile your sittin in the bucket good luck anyway

Well, i was dropping off a couple friends of mine who aparently had warrants out for there arrests (at the time i didnt know this, they didnt tell me) and when i pulled up to there house 4 undercover cops came out of a ford explorer and handcuffed my two friends, and they started questioning me about why i was with them etc etc. Then they searched the car and found my friends needles, and then the cops start4d asking me if im high and i told them no, because i seriously wasnt, but i had gotten high on H the night before. So they did a bunch of ridiculous tests on me, making me tilt my head back and close my eyes, then they would shine there flashlight on my eyes and somehow they determined i was high, so they cuffed me and told me i need to go back to the police station and give them a urine sample to show if im high or not and if i dont they will take me to jail and forcefully take my blood, which is total bs because i knew i would test positive because i used the night before, so i felt trapped in a corner and went and pissed for em, got taken to jail and thankfully got ORed (released on my own recognicence).

Yeah it scares the shit outta me how fucked shit is in the states... I get this feeling that some catastrophic event is gonna happen in the states soon, makes me want to get out of here ASAP haha.

Wat woulda happened to me in America if; i was stopped 8am in the morning and was 5ml over the new drink drive law(Its just been reduced over here to 26)?
Cops stopped me here, i told em i was on my way to pick my kid up and had been to sleep.from the night b4 .He saw i was cool and no danger and just told me the limit had been lowered.And sent me on my way..

What would happen is you would be taken to jail and charged with a DUI, and have to spend a mandatory 48 hours in jail for being over the drinking limit. But you could pay a couple thousand dollars and bail out and serve your mandatory 48 hours later on, but thats kind of pointless because jails are so crowded around here (southern California) that you would still edn up spending at least 24 hours in holding cells waiting to be processed. And along with that DUI would mean you lose your driving lisceanse for up to like 2 years i think (not totally sure if its that long maybe only a year to a year and a 1/2) and hgave to take a certain amount of mandatory Alcohol awareness classes. Thats all i personally know from my friends telling me what happened to them when they got DUI's, could be more Bullshit you have to do.

1rst did you end up posting a bond?

2nd DO NOT GET a P.D. unless you do wanna take the chance of getting fucked by the system...

3rd, talk to any attorney & just ask hin what a 11550 is? & ask him what the worst case is, like a possesion in chi is carrying a 1-3yrs & a fine, but w/no record you can get offf w/just drug school or a 1410 probation which is 2yrs of checking in once a month to your probation officer & prob do 4 drops random in 2yrs.
In them 2yrs you do not catch any other felony cases or anything SERIOUS, the 1410 probation will be off your record, unlike a regular probation which stays for about 7yrs & then you can get it expunged w/some cash.

BUT EVERY STATE IS DIFFERENT, BUT JUST CALL ANY LOCAL ATTORNEY & HE WILL TELL YOU FREE OF CHARGE WHAT YOU ARE LOOKING AT.

hey sorry about your charge. First off, courtrooms are public. If you have time, go in one week before your court date (they usually hear similar cases on the same day of the week) to the same courtroom. This is the #1 thing you can do to prepare yourself (besides getting a lawyer). If you are lucky, you will hear some cases similar to yours tried. And you can see what really happens, what your judge is like - what pisses him/her off, what he/she likes, and most importantly, what happens to people who have your charge.

Also, you can see how it works- what to wear, where to go, where to stand, etc. so you are as calm as possible when its your turn. When you are calm, you are more likely to do and say the right things.

Obviously, consult with your PD. See if they are worth a shit. If not, try to find a lawyer to take your case.

Try to enroll in some type of drug treatment, and get proof you are enrolled to show the court. This helps BIG TIME. See below:

Get on methadone, and tell your m-done clinic doc about your court case, ask your doc what happens to people from the clinic who get thrown in jail. This will also count as enrolling in drug treatment program, which is a big deal. Get proof you are enrolled. The nice thing about enrolling yourself before court is you can choose your program, and the court will usually let you continue going there instead of assigning you to the court program.

And try to taper down your habit as much as possible, just in case the worst happens. If you have any decent scripts for opiates, get good documentation of these and you might be able to get them dispensed in jail.

Take days off from work. This is your ONLY priority for the next few days. PREPARE YOURSELF.

Codone, the best info I could give you is to go to a methadone clinic, in some states they will actually give you your dose in jail, BUT ONLY IF YOU WERE GOING BEFORE YOUR ARREST/SENTENCE!! If this is the case you can find out, but ask a civilian, some authority figures will give you the answer they want to give you, usually a lie. Also, if they are talking any jail time as part of a plea, don't take it, better deals will come later. In other words, don't take the first deal they throw at you. Plead not guilty, I'm sure they don't wanna waste thousands of dollars on a trial just for some bullshit. Make sure they know that you will go to a trial, this is the only real leverage you have. Also, do not admit that you might have been high to your public pretender, they are officers of the court and will more or less sell you out. Deny Deny Deny, like O.J.!! I was not high, remember those words, even start saying it just so it sounds convincing when you say it in court, I was not high!! I have been through this same shit before, as you can tell.

Were you arrested for driving under the influence? Or just being under the influence? There is a really big difference between the two as far as sentencing.

If you were driving under the influence......get a lawyer immediately.

If you were just under the influence it should not be a big deal. In NY it is similar to disturbing the peace. Maybe a fine and at most some probation. If you come to court showing that you are receiving some sort of treatment already they may just let it go at that.

Good luck. The legal system is a bitch. I have been arrested a few times, never for drugs, but I always get fucked in the ass moreso than others with the same charges. I look like a good, little , Christian boy too, but Lee County Florida is fucked up. Wilmington is just as fucked up, but at least I have stayed out of trouble here so far.
