View Full Version : Buying a pistol & Suboxone

I went and bought a Berretta 9MM a couple of days ago, and am awaiting the 10 day background check to go through before I get it. My question is, when I was reading the gun owner manual (for Californians) I noticed that it stated that no narcotic addicted people can own or purchase a gun in the state of California. Now, since I am on suboxone, is this going to be a problem for me. Are they going to decline me the gun due to the fact that I am on a program? I have never done this before and am a little confused as to the rules and regulations that go along with purchasing a hand-gun. I love shooting, it is a hobby of mine. I am quite a marksman and would be greatly PISSED OFF if I was unable to own a gun. Anyone who would know anything on this subject, I would be greatly appreciative.....thanks

This is why I bought all of my firearms before I resumed my treatment for chronic pain. :(

The body of law in most american states, california most of all, is full of all kinds of shit -- particularly when it comes to drugs and guns.

I imagine that the laws definately surround those with mental illness or felony convictions, or someone with a history of violence or suicide.
Could it be that what you read referred to those convicted of drug offenses for the sale or use of narcotics? Just a thought. They may consider the use of Suboxone as a medical treatment, which may be OK in terms of owning a gun.
I really just don't have that kind of info nor am I familiar with this topic. Check out the site below and maybe there you can find the info you need.
It would really be a shit deal if you could not own the gun, but unless they do a urine test or some other kind of testing, is it something they are even going to know about? I have never owned a gun as such, so I am unfamiliar with obtaining the permit or license. Do they need to know that kind of personal information from you? I do have a friend who owns guns. Maybe he can offer some idea of what the law covers

your medical records are private. so as long as you haven't been convicted of a drug related crime they won't have any reason to stop you. gun laws are bullshit. the only gun law that should matter is Article II of the US constitution, "the right of the people to keep and bear Arms, shall not be infringed."

Good on ya for purchasing a gun! Too bad you have to live in California, though. They have the shittiest gun laws in the country, besides the District of Columbia, prolly.

PK is totally right on. Your suboxone thing is between you and the doctor. Unless it's a state-run program, your records are confidential. Don't volunteer that information either, because if you do, they will probably disqualify you.

If you're not "on paper" or have a criminal record, you're fine.

I have the same thing, because my wife and I are applying for concealed carry permits, which are relatively easy to obtain in our state. We just have to take a little course and pay fifty bucks. But the questionnaire asks if "you are addicted to marijuana or any other narcotic?" I said "no."

Well its looking good so far, I was convicted on marijuana charges like 6 years ago, actually a couple of em, but it didnt say anything about any other drugs but narcotics. Well I guess my question has been answered. So my medical records cannot be sought out after, its just between me and Doctor Money. (thats what I call my bup doc) thanks guys and galls

The marijuana was a midemeanor, right? If you've been convicted of a felony, then you lose your right to own a firearm and the right to vote (which is VERY harsh, probably the harshest thing about the conviction, besides prison).

too bad. if i remember correctly, you can buy at gun shows (person to person) without any checks. i'm sure i saw that someplace on the news but then like they said, california....

check it out and see if you could get a better price as well.

THE REAL reason that's on there I'd imagine is so that they can send you to felony hell if they catch you with both drugs -and- a gun at the same time.

Yes, I bought the gun at a gun store. I actually just got back from there about an hour ago and made my last payment. I passed the test with a 100% score, ohhh yeahhhh, I rock!! Anyways, now I just have to wait 10 days for the background check and I get to go pick it up. The weed tickets I got a while ago are still on my record, but I dont think that will be a deal breaker, or atleast I hope so. I will let you know how it all goes on January 17th!!!

It used to be that way in Oregon. However, a couple of years ago they passed a law requiring background checks at gun shows in that state. I remember an occurrence at one show that was so Thompsonesque as to be one of my favorite memories to date (I know I have problems.) A Dwarf who looked exactly like "Tattoo" from Fantasy Island was standing atop a rickety old milkcrate, staring down the scope of a Dragunov, pretending to pick off various attendees of the gun show. The vendor watched on with little regard.

I'd likely do something stupid like say "No Officer, I just have the gun so I can destroy these dangerous narotics before they fall into the hands of some impressionable youth". At that point I'd drop whatever drugs I had on the ground and proceed to blow them to Hell. Assuming the cop wouldn't panic and shoot me, I'd still be going to jail. I suppose the hope is not that he'd believe me, but that he'd say "That's the most creative lie I've been told all week,....you just made my day, I suppose there's no evidence, and your friend has a conceal carry permmit for a licensed firearm. I'm just gonna' let you off with a warning." (Sigh),....but this could never happen.

All my buddies went to a gun-show about 2 years ago (I didnt go) but this was the story I was told. I swear to god this is a true story, anyways, he was inspecting a 22 rifle and pulled the trigger, guess what happened.....It was loaded. He shot a round off and it richoceted off the ground and hot some guys leg. The cops showed up and interrogated him for almost 3 hours. He was in no trouble cause the gun SHOULDNT have been loaded in the 1st place. I thought this was hillarious and wanted to share it......lates

To answer your question EW, I got a call from the shop I puchased it from and there was a problem with my DMV record. I guess I had a fix-it ticket I never took care of, thus ending my purchase till I can get it fixed. So yes, I will be getting it, it will just be a couple of months down the road. Fuckin Cali laws can suck my rod!!!

Wow, I just found this thread and I know it's old so sorry for bumping it, but I wanted to know if you ever got your weapon.

I bought a new handgun a few months ago, and this was after I had been to the opiate clinic for possible Suboxone induction. My wife, Mrs. Killer, got the Subs but I was denied because I wasn't in WD ( long story for another time...). However, I was still admitted for outpatient therapy (ie. group, counseling, and future Suboxone induction if I wanted), so I know that would be on at least some of my insurance records.

Yet I had no prob whatsoever getting my gun (a sweet Bersa .380 9-shot semi-auto, loaded with Winchester hollow-points---basically a scumbag-dropper---it rocks, and I can carry it in my pants pocket), and we only have a 3-day waiting period, so I basically got it right away.

As an aside: I felt compelled to purchase this weapon after I fired a scum-bag employee of mine (he was padding his hours, talking smack and ruining morale on the crew, so I shit-canned his wigger wanna-be ass). Well, this fuck took it upon himself to come and smash the windows of my work truck, break into my garage and steal a bunch of valuable tools, and then proceded to begin a campaign of threatening phone harrassment that scared the piss out of my wife. So, using our Wisconsin.org website, I was able to track down his info, contacted his PO officer (who had him tossed in jail for almost 2 weeks), and got a one-year restraining order against him.

This is a person that I would have absolutely no problem pointing my gun in his face and pulling the trigger. I am normally a "live and let live" type of guy, but this fuck caused so much grief and turmoil to me and mine, that I would LOVE it if he'd come over here and allow me to pump a few rounds into his ugly fucking face. I would watch him die, then go snort some H and sleep like a baby that night. Ya hear that Paul Beckwith, you piece of shit? I'm waiting for you....

Anyway, I love my gun. Thanks for listening.

Yeah man, 380s' are great. I like the small 'fit in the palm of yer hand' model. Powerful little pieces, thats fer damn sure. When I lived in Tucson we used to go shootin all the time out in the desert. You NEVER GO BY YOURSELF. People get killed for thier guns all the time out there. My friend made the mistake of goin plinkin in the desert by himself at a cirtain spot that alot of people go to. Well he's there doin his thing and all of a sudden POPPOPPOPPOPOPOPOPOP! RIGHT NEXT TO HIS HEAD! Some dude with a fully auto A.K. 47 did it on purpose to scare the shit outta him and it worked. He never went out there alone again. Like they say in Tucson, "Out there, in the desert, they'll never find your little mound."

I too have a Smith & Wesson snub-nose .38 w/ Winchester hollow-pts (as well as the regular ones) and my husband's grandfather gave me his Browning 16-gauge (I use Remington Shurshot field load). My dad gave me one of his revolvers in college, to keep under the seat, driving back and forth from home... he just said put it on the seat if a cop pulled me and say it was my dad's. (He leaned toward revolvers 'cause they can't jam like semis.) Then, I got my own about 10 years ago. I also am a good shot and use to regularly practice. And Shaun, I had a few DMV blotches, but took care of them, and never had a problem.

Before children, my husband travelled a LOT, so it was just me and the felines... that's when I figured I needed something more. Just in case. My neighbor use to joke I should leave the "man silhouette" taped to the front door with the 16-gauge's damage... better than any alarm.

Now, of course with children, I keep them locked in the hidden wall safe. Well, the shotgun's just unloaded and in the linen closet.

Z_K, I just fixed my DMV record the other week, so I should be able to get that beretta real soon. I will keep you all updated. I am actually thinking about the vertec (sp) model instead, but only if they have it in a nice chrome color. I dont like the jet-black beretta look, it has to have that silver sparkle look to it.
