Well i got my discovery back from the DA and my blood screen results were included:

"Specimen: Blood Sample

FLS Abuse Screen:
Cocaine & Methamphetamine by Immunoassay = Negative
Opiates, Benzodiazepines & THC by Immunoassay = Positive

Large amount of Morphine & small amount of Codeine confirmed by LCMS

Large amount of clonazepam confirmed by LCMS

Small amount of THC & metabolite confirmed by LCMS

Note: Oxycodone & metabolite detected in blood, quantification available upon request."

Great, sounds like me alright. I love how quantitative those results are, "Large amount." Just fucken great. That blood test was taken after a traffic stop along with some pretty damning accounts by the police. Any clue what they're going to do to me?

Sorry to hear BP! I'm curious... the cops took a blood sample from you after a simple traffic stop? That'd be pretty rough, wow. I wrecked into a log cabin once and they took blood, but that was after I woke up in the ER. I got a fat lip... the guy in the house claimed I knocked him out of bed and broke his rib, LOL.

Well, seriously hope that you work this out somehow man. Best wishes!!

for what it's worth maybe you won't have to cop to "Morphine" as Codeine breaks down into it. Probably not a big help tho'

So sorry to hear that BP. When did all this happen? With a good lawyer, you shouldn't get much hopefully. They just never give up.

Can you produce old script bottles or any current scrips for the benzo and opiates? Swear that it must be passive thc from those people you were trapped in the van with when you hitched a ride home the other day? Good luck-good lawyers can save you from a lot of shit, but you hate to fork over the cash.

Sucks man...Just wondering though, can they say when you dosed though? Peak plasma levels, etc? What if those were taken days prior to driving? Not sure if CA has those laws reguarding possesion via consumption...Definately advise a lawyer, and uh i hope you don't have too many\too serious previous offense...Might be better to just refuse a blood test and get your license revoked than get charged with a bunch of crap ;\

First, BP, let me say how damn sorry I am! Totally sucks, but you need to count your pennies and, like everyone said, get an experienced criminal defense lawyer, one with DUI and/or drug intoxication experience but NOT some idiot off the back of the phone book. Most State Bar Associations have referrals services. The link for the California Bar's referral service is: http://www.calbar.ca.gov/state/calbar/calbar_generic.jsp?cid=10182

And ask friends, family... like a good doctor, the best way to find a *good* lawyer is to ask around.

DO NOT GO FOR CHEAP, and don't bitch about the lawyer's hourly rate! You can and should hammer out rates prior to the engagement (you can ask for up to a 10% discount after you learn his/her rate, and for an advance itemization [a guesstimate, really] regarding the time he/she anticipates spending on your case (e.g., "I anticipate it will take 10 hours of my time, plus expenses, to negotiate a plea bargain, and another 40 hours if it goes to trial). You want an estimate of expenses, too, and a list of what he/she expects reimbursement for. You don't want to pay for a limo to wait out front to pick him/her up after trial!;)

Borrow money for a good lawyer... you're paying for your future freedom! An ounce of prevention (that is, preventing your ass from going to jail) is worth a pound of cure (in other words, trying to appeal a convinction, which is almost never successful.

Best wishes! I remember the facts of your case, and a good lawyer really can turn this on its head, and in your favor, I think!

Thanks everyone for the kind words! I already got a lawyer (not exactly the best money can buy) so its kinda too late to employ NZ's lawyer fee negotiation technique. But thank you for the info anyway! If I get busted yet again i will certainly use it.

I will let everyone know how it goes. I'm just starting a new job next week so it would be a really bad time to have to go do 90 days in county.
